Execution Law Reform in Azerbaijan: Tougher Penalties for Non-Compliance

Azerbaijan has introduced significant amendments to the Law “On Execution” aimed at strengthening the enforcement of court and administrative decisions. These changes increase the financial burden on debtors who fail to comply with legal rulings within the prescribed voluntary period without a valid reason. The goal is to deter delays, reduce enforcement backlogs, and enhance the rule of law.

Key Legal Amendments:

  • The execution fee has been raised from 7% to 10% of the total recoverable amount in cases involving monetary claims.
  • In cases where the enforcement does not involve money or property, such as mandatory actions or prohibitions:
    For individuals, the fee increases from 11 AZN to 100 AZN.
    For legal entities, the fee increases from 55 AZN to 500 AZN.

These amendments reflect the government’s commitment to promoting timely compliance with judgments and administrative decisions and discouraging intentional resistance.

Who Is Affected:

  • The amended law applies to a wide spectrum of parties:
  • Azerbaijani citizens and residents
  • Local companies and commercial organizations
  • Foreign businesses involved in legal proceedings or enforcement cases in Azerbaijan

Creditors—including banks, lessors, private claimants, and corporate plaintiffs—are expected to benefit from a more efficient and predictable enforcement system.

Companies that ignore or delay enforcement decisions may now face significantly higher penalties. These legal developments send a clear message: non-compliance will be costly.

  • Monitor Legal Deadlines: Ensure internal legal teams track court decisions or enforcement notices.
  • Act Promptly: Fulfill obligations during the voluntary execution period to avoid elevated costs.
  • Document Valid Justifications: If you cannot comply due to reasons such as illness, force majeure, or operational disruption, gather evidence and consult with legal counsel.
  • Update Internal Policies: Revise compliance workflows and educate relevant departments on the new rules.
  • Proactively Engage Enforcement Authorities: In some situations, communication with the execution officer may help mitigate consequences.
