Parliament Proposes Significant Increases in Fines for Tax and Financial Information Violations
During the most recent session of the Parliament, a new draft law proposing critical amendments to the Code of Administrative Offenses was introduced and successfully passed in its first reading. These changes signal a shift toward international transparency and stricter compliance regarding the exchange of tax and financial data.
Enhanced Penalties for Non-Compliance with International Inquiries
The proposed amendments significantly increase the financial liability for persons not registered as taxpayers who fail to cooperate with international information exchange requests.
- This applies to information and document requests received from foreign jurisdictions under international treaties to which the Republic of Azerbaijan is a party.
- Failure to submit required documentation within the timeframe established by the Tax Code, or the provision of intentionally distorted data.
- Statutory Fines:
- Individuals: Increased from 50 AZN to 300 AZN
- Legal Entities: Increased from 100 AZN to 1000 AZN
New Penalties for Inaccurate Residency Reporting
To ensure the integrity of international financial reporting standards, the draft law introduces a specific penalty framework for misrepresenting residency status to financial institutions.
The penalties apply under the following circumstances:
- Providing inaccurate or distorted information and documentation during the account opening process or while receiving financial services.
- Failing to notify a financial institution within the legally mandated timeframe of any changes in circumstances that affect an individual’s or entity’s residency status.
- Statutory Fines:
- Individuals: 300 AZN.
- Legal Entities: 1,000 AZN.
These amendments reflect the state’s commitment to international standards of financial transparency. For foreign investors and local entities, this emphasizes the necessity of adhering strictly to the deadlines set by the Tax Code when responding to official inquiries and avoiding intentional distortions
The bill has passed the first reading. It will undergo two more readings before being sent to the President for signature.
